TERMS AND CONDITIONS - General Terms

Safetyscope Inc. hereby offers to furnish all necessary expertise, supervision, materials, equipment and other things necessary to complete the tasks as described in the project’s Scope of Work.
Engagements may be changed by the Client however, any changes to the Scope of Work may affect pricing, timings and/or deliverables. In addition, the Client may also be charge for specific expenses and commitments already incurred or made in connection with the engagement.
Rates
Commencement of billable hours shall begin when Safetyscope Inc. personnel depart from our closest office to travel to your site.
We maintain the right to refuse to use client supplied equipment if it is not fit for the job that will be performed. Our personnel will notify you of any defects that will affect your rate prior to the project commencing. If the project is terminated as a result of this refusal you will be billed a minimum of 6 hours at the “No Equipment” Rate. For any equipment not supplied by the client to complete the project, you will be billed based on our equipment rental rate. The amount charged will not exceed the rate charged if we were to supply all the equipment.
Rapid Response Rates apply only to the first day of any multi-day project. Annual contract rate discounts apply to Rapid Response Rates.
Any standby time charges will be billed at our applicable rate.
Project Personnel
Safetyscope Inc. expects the Client to assign a senior member of management to ensure optimum communication and program performance. The Client’s liaison should have authority to act on all safety issues requiring immediate attention.
Safetyscope personnel chosen for each job will have completed as a minimum a NFPA 1670 Confined Space Rescue and High Angle Technician Level programs,
an Advanced First Aid with AED/CPR, NFPA 470 Hazmat Technician Level, NFPA 600 Fire Extinguisher Handling, Ontario WSIB Part 1 Certification Course, training on Hazard Assessment/JSA, General PPE, including Supplied Air and Air Purifying Respirators, Asbestos Awareness, Propane - Construction Heater, Fall Arrest, WHMIS and Lockout.
Cancellation Policy
Safetyscope Inc. engagements may be cancelled by the Client up to 1 hour prior to projected departure time from our offices without any charge. For engagements cancelled after our personnel depart our offices, the Client will be charge our 4 hour minimum charge and for any travelling expenses incurred.
Billing Policies
Invoices will be remitted upon:
a) completion and acceptance of all work under the contract, or
b) for long term projects, at the end of each week.
All invoices remitted are payable upon receipt. Accounts unpaid 35 days after the date of the invoice will be charged interest at 1.2% per month (16% annual effective rate).
Confidentiality and Security
All confidential data and information concerning the Client obtained by Safetyscope during the performance of its services under this Agreement shall be treated accordingly.
Safetyscope agrees that its personnel when using the Client’s premises will comply with all security regulations enforced at such premises.
Equipment Security
Any expense incurred to replace or repair the equipment damaged beyond the wear and tear cause by normal use shall be charged to the client.
For Safetyscope Inc. equipment to be left on client site overnight during the project there must be an adequately secured area to prevent any loss or damage to the equipment. If an area is not available equipment set up time each morning will be charged to the client at our normal billable rate.
Proprietary Information
Safetyscope Inc. materials (Entry Permits, Logbooks, Confined Space Procedures, Hazard Management Plan and Training Handouts) are copyrighted. Safetyscope grants the Client the right to create copies of the materials as required for this specific project. The Client may not copy, transfer or otherwise use these materials, in whole or in part, for any other purpose without prior authorization from Safetyscope Inc.
Limitations
Safetyscope Inc.’s work is intended to assist the Client in reducing the possibility of loss by noting hazards which are found. Safetyscope Inc. does not guarantee an accident free workplace. Furthermore, Safetyscope Inc. does not assume management’s responsibility to maintain a safe workplace as outlined in the Ontario Occupational Health and Safety Act.
